1. General – applicable to all Nicely Personalised competitions
1.1 Syxth Limited trading as Nicely Personalised is (“the Promoter”).
1.2 We are registered in England and Wales under registration number 9221533, and our registered office is at The Gables, Marston Lane, Frome, Somerset, BA11 4DS, United Kingdom.
1.3 Our competitions are open to all adults, world-wide aged 18 years or over except for employees of Syxth Limited / Nicely Personalised and their close relatives and anyone otherwise connected with the organisation or judging of the competition.
1.4 By entering our competition an entrant is indicating his/her agreement:
a) to be bound by these rules – see Section 2.
b) to receive future marketing communications from Syxth Limited / Nicely Personalised. We will never provide your details to any third party company without your prior express permission. Please refer to our Privacy and cookies policy for further information.
1.5 All country / state specific laws and regulations apply. Our competitions are void where prohibited.
1.6 No purchase or payment is necessary to enter or win. A purchase or payment will not improve your chances of winning.
1.7 Competition specific information such as the competition reference number, competition title, competition period, competition random draw date, competition prize details and competition winners name(s) will be appended to this document in Addendum A – Individual competition details and will appear in reverse chronological order (most recent competition first).
1.8 Our competitions run across multiple social media platforms world-wide. Our competitions are in no way sponsored, endorsed or administered by, or associated with:
d) Google; or,
e) any other social media network that we use from time to time.
1.9 You understand that you are providing your information to Syxth Limited / Nicely Personalised and not to any of the social media networks as listed in 1.8 above.
2. Binding agreement
2.1 To enter the competition, you must agree to these official rules.
2.2 Please ensure you read them prior to entry to ensure you understand and agree.
2.3 You agree that submission of an entry in the competition constitutes agreement to these rules.
2.4 You may not submit an entry to the competition and are not eligible to receive the prizes described in the official terms and conditions, unless you agree to these rules. These rules form a binding legal agreement.
2.5 By participating in the competition, each participant and winner waives any and all claims of liability against the competition Promoter, and their employees and agents, their respective employees and agents, for any personal injury or loss that may occur from the conduct of, or participation in, the competition, or from the use of any prize.
3. How to enter
3.1 Qualified entrants must have participated in our referral reward competition during the competition period – see Addendum A.
3.2 Entries are automatically submitted upon receipt and verification of qualified referral.
3.3 The competition Promoters are not responsible for lost, late or misdirected email; server unavailability; or computer or any other electronic or telecommunications malfunction.
4.1 Any false information provided within the context of the competition by any participant concerning identity, mailing address, telephone number, e-mail address, ownership of right or non-compliance with these official rules or the like may result in the immediate elimination of the participant from the competition. The competition Promoter further reserves the right to disqualify any entry that it believes in its sole and unfettered discretion infringes upon or violates the rights of any third party, otherwise does not comply with these official rules, or violates English, or applicable country or local law.
5. Winner selection
5.1 The winner(s) will be randomly selected on the random draw date – see Addendum A.
5.2 The draw will be made by computer at random from all qualified referral entries.
5.3 The odds of winning a prize are determined by the number of qualified referrals during the applicable prize period.
5.4 Every competitor may increase their individual chance of winning by making additional qualifying referrals.
6. Winner notification
6.1 The winner(s) will be notified either by phone or email within 7 days of the random draw.
6.2 If a winner cannot be contacted or does not claim the prize within 14 days of notification, the Promoter reserves the right to withdraw the prize from the winner and select a replacement winner. All prizes will be awarded.
6.3 It is your responsibility to check this page occasionally to ensure you are happy with any changes to this policy.
7.1 No transfers or substitution in prizes will be allowed except by Syxth Limited, who may substitute a prize of equal or greater value in its sole or absolute discretion.
7.2 Each winner must arrange for and accept prize delivery no later than 10 days following the award of the prize.
7.3 By claiming the prize, the winner authorises the use, without additional compensation, of his or her name and/or likeness and/or voice/photograph and municipality of residence for promotion and/or advertising purposes in any manner and in any medium the competition Promoter may deem appropriate.
8. Additional rules
8.1 The conduct of the competition is governed by the applicable laws of England, which takes precedence over any rule to the contrary herein.
8.2 The competition Promoter is not liable for any lost or stolen entries, prizes or competition information.
8.3 By participating in the competition, participants agree to be bound by the decisions of competition Promoter’s personnel. The competition Promoter reserves the right to disqualify any participant or winner and may refuse to award any prize to a person who is ineligible or has violated any rule, gained unfair advantage in participating in the competition, or obtained winner status using fraudulent means. The competition Promoter will interpret these rules and resolve any disputes, conflicting claims or ambiguities concerning the rules or the competition and competition Promoter decisions concerning such disputes shall be final. If the conduct or outcome of the competition is affected by human error, any mechanical, technical, electronic, communications, telephone, computer, hardware or software errors, malfunctions or failures of any kind, intentional interference or any event beyond the control of the competition Promoter, the competition Promoter reserves the right to terminate this competition, or make such other decisions regarding the outcome as the competition promotor deems appropriate. All decisions will be made by the competition Promoter and are final. The competition Promoter may waive any of these rules in their sole discretion..
8.4 The competition Promoter reserves the right to withdraw or terminate this competition at any time without prior notice.
